Limited Warranty

BY USING A PRODUCT MANUFACTURED BY OR FOR ADAPTIXSOLUTIONS (A "PRODUCT") YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THE ADAPTIXSOLUTIONS INC. LIMITED WARRANTY (“WARRANTY”) AS SET OUT BELOW. DO NOT USE YOUR PRODUCT UNTIL YOU HAVE READ THE TERMS OF THE WARRANTY. IF YOU DO NOT AGREE TO THE TERMS OF THE WARRANTY, DO NOT USE THE PRODUCT AND RETURN IT TO US UNOPENED WITHIN 30 DAYS OF PURCHASE FOR A REFUND.

AdaptixSolutions' obligations for the Product purchased by the end-user ("You") are limited to the terms set forth below:

30 Day Fit Guarantee

AdaptixSolutions guarantees the Product will fit and produce satisfaction or it can be returned within the period of 30 days from the date of your purchase ("30 Day Fit Guarantee").

90 Day Warranty

AdaptixSolutions warrants the Product against defects in materials and workmanship under normal use for the period of 90 days from the date of your purchase ("90 Day Warranty").

Lifetime Replacement Guarantee

Purchasers who purchase by calling AdaptixSolutions, use AdaptixSolutions website, or purchased the glasses at a retail outlet and registered with AdaptixSolutions within the specified period on the retail package, are covered by a Lifetime Replacement Guarantee that extends the 90 Day Warranty covering your glasses for as long as you own them.

Replacement terms

If a defect in materials and workmanship arises and a valid claim is received within the applicable warranty period AdaptixSolutions will replace the Product with a product that is new or reasonably equivalent to the original Product. Shipping and handling charges of $5 (additional charges for international addresses) may apply except where prohibited by applicable law. We may at our option ask you to send the defective glasses back with a pre-paid envelope we will provide you with the replacement. If you fail to send them back, we may at our option charge you the full price of the glasses. Any replacement product becomes your property. Any Product returned to AdaptixSolutions becomes its property.

Exclusions and limitations

Except as expressly set forth in this Warranty, AdaptixSolutions, in so far as permitted by law, provides their Products "as is". AdaptixSolutions is not responsible for damage arising from failure to follow instructions relating to use of the Product.

This Warranty does not apply: (a) to damage caused by use with another product; (b) to damage caused by accident, abuse or misuse, including, but not limited to, scratches and broken lenses; or (c) to defects caused by normal wear and tear or otherwise due to the normal aging of the Product.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. AdaptixSolutions’ responsibility for defects is limited to replacement service as determined by AdaptixSolutions in its sole discretion.

TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS, OR WARRANTIES. ADAPTIXSOLUTIONS EXPRESSLY DISCLAIMS ANY STATUTORY OR IMPLIED WARRANTY OR CONDITION, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SATISFACTORY QUALITY, NON-INTERFERENCE, OR ACCURACY, OR ARISING FROM A COURSE OF DEALING OR TRADE PRACTICE, TO THE EXTENT ALLOWED BY APPLICABLE LAW.

To the extent an implied warranty cannot be excluded, such warranty is limited in duration to the period set forth above. No warranties, whether express or implied, will apply after the expiration of the applicable warranty period. Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you.

No AdaptixSolutions dealer, distributor, reseller, agent, or employee is authorized to make any modification, extension or addition to this warranty.

ADAPTIXSOLUTIONS SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR REVENUE, OR COMMERCIAL LOSS EVEN IF ADAPTIXSOLUTIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of special, indirect, incidental, or consequential damages, so the above limitation or exclusion may not apply to you.

AdaptixSolutions may restrict service to the fifty states of the United States of America and the District of Columbia. In accordance with applicable law, AdaptixSolutions may require that you furnish proof of purchase details and/or comply with registration requirements before receiving warranty service.

Note that in the European Union, any warranty period less than two years shall be increased to two years.
